Stupid Fun Games Terms of Service

Short version: play nice, don't cheat, don't be a jerk to other players, and don't take the leaderboards too seriously. The games are free and come as they are, so we can't promise they'll always work, or be around forever. You can play without an account; if you make one, you accept these terms, and you can leave any time by deleting it. The long version below is the one that counts. We tried to keep it readable.

What Stupid Fun Games is

Stupid Fun Games is a free website of small, silly games you play in your browser, at https://stupid-fun-games.com ("Stupid Fun Games", "we", "us"). These Terms of Service (the "terms") are the rules for using it, in all its languages, including its optional accounts.

You can play every game without an account. If you want, you can sign in with Google or Discord to get one, which adds leaderboards, daily streaks, badges and friends.

Today everything on the site is free: there's nothing to buy and no subscription. If we ever offer something you pay for, it will come with clear terms of its own before you pay a cent.

Agreeing to these terms

By using the site, you agree to these terms. If you don't agree, please don't use it (we'll miss you).

When you create an account, we ask you to accept these terms explicitly, by ticking a box, before your account features switch on. We record the date and the version of the terms you accepted.

How we handle your personal data is explained in our Privacy Policy. It's information for you rather than a contract to sign, but please read it: it has jokes too.

Who can have an account

Anyone can play the games without an account. To create one:

  • you must be at least 13 years old, and at least the age of digital consent where you live if that's higher (the age from which you can use online services like ours without a parent's consent: up to 16 in parts of Europe);
  • if you're old enough but still a minor where you live (usually under 18), you need the permission of a parent or legal guardian, who should read these terms with you; when you accept them, you confirm that you have it;
  • you must be allowed to use the site under the laws that apply to you.

If we learn that an account belongs to someone below the minimum age, we'll delete it, as our Privacy Policy says. If you think that's the case for an account, write to privacy@stupid-fun-games.com.

Your account

  • One account per person, and one person per account: no shared accounts, and no extra accounts to farm badges, boost scores or get around a suspension.
  • You sign in with Google or Discord, so keep that account secure: whoever controls it controls your account here. If you think someone else got into it, tell us at privacy@stupid-fun-games.com.
  • Use your own Google or Discord account, and don't pretend to be someone you're not.
  • You're responsible for what's done with your account, so don't let other people use it.

Nicknames and avatars

Your nickname and avatar are public: everyone can see them next to your scores. So, no nicknames (or avatars) that:

  • are offensive, hateful, sexual, violent or harassing, in any language or in disguise (l33tspeak counts);
  • impersonate anyone: another player, a real or famous person, or us (nothing that looks like "admin", "moderator" or "official");
  • contain personal information, yours or anyone else's, such as a full name, a phone number or an address;
  • advertise anything or carry links;
  • use something you don't have the right to use, such as someone else's trademark.

If you pick your Google or Discord picture as your avatar, it's shown publicly, so make sure you're happy with that. Our automatic filter catches some bad nicknames, not all of them: the rules apply either way.

Play nice: the rules

When you use the site, please don't:

  • cheat: no bots, scripts, macros or other automation playing for you, and no faking, editing or replaying scores or the requests that send them;
  • exploit bugs: if you find one that hands out points, badges or anything else, enjoy the laugh, then tell us at privacy@stupid-fun-games.com instead of farming it;
  • harass anyone: no bullying, threatening or stalking other players, friends included, and no spamming friend requests;
  • try to get into accounts or data that aren't yours, or get around our security or our limits on requests;
  • scrape or bulk-download data from the site or its API (the addresses under /api/), use automated tools on the API, or overload any part of the site: it runs on a tiny budget, and every request counts (search engines indexing our pages are welcome);
  • use the site to break the law, to infringe anyone's rights, or to hurt anyone;
  • help or encourage anyone else to do any of the above.

What we can do about it

We don't watch everything that happens on the site, and we don't have to. But if we notice, or someone tells us, that an account breaks these terms or harms the site or other players, we may, at our discretion and without notice:

  • reset your nickname (you'll be asked to pick a new one) or your avatar;
  • remove or correct scores, streaks or badges;
  • suspend your account, or delete it.

We try to be fair and proportionate: a silly nickname usually just gets reset. If you think we got it wrong, write to privacy@stupid-fun-games.com and we'll take another look.

Leaving

You can stop using the site whenever you like. To delete your account and everything attached to it, go to Profile → Danger Zone: it's immediate and permanent. If you can't sign in any more, write to privacy@stupid-fun-games.com from your account's email address and we'll delete it for you.

We may also close accounts as described above, or stop offering accounts altogether. Deleting an account ends its part of these terms; while you use the site, signed in or not, the rest still applies. The parts that are about the past keep applying after you leave: who owns what, the disclaimers and limits of liability, indemnity, governing law and the other legal bits.

Take me to the Danger Zone

Scores are for fun (and only for fun)

Leaderboards, streaks and badges are for fun and bragging rights only. There are no prizes, no money and nothing else of value attached to them, and they can't be sold, traded or transferred.

Scores are sent by your browser, so some cheating will slip through and some results may be wrong. We may correct, remove or reset any score, leaderboard, streak or badge, change how they're counted (we've done it before), or remove these features altogether. Daily and weekly leaderboards are cleared regularly, as our Privacy Policy explains.

Who owns what

The site and everything on it, including the games, the code, the drawings (avatars included), the texts, the jokes and the design, belong to Stupid Fun Games or its licensors and are protected by copyright and other laws. We give you a personal, non-exclusive, non-transferable, revocable permission to use the site and play the games for your own non-commercial fun, under these terms. Anything else, such as copying the games, the art or the site, or selling access to them, needs our written permission. Sharing screenshots and videos of your games is welcome.

Some pieces belong to others and come with their own licences: the joystick in our site icons is from Google's Noto Emoji, under the Apache License 2.0 (see the licence and changes), and the fonts are under the SIL Open Font License.

You keep whatever rights you have in your nickname. You allow us to store it and show it, with your avatar and your scores, on the site for as long as your account exists (and briefly after you delete it, as our Privacy Policy explains).

If you send us ideas or feedback, we may use them freely, without owing you anything. Thank you in advance.

Other people's services

Signing in works through Google or Discord, and the site is hosted by Cloudflare. Your use of Google or Discord is governed by their own terms and privacy policies, not ours, and we're not responsible for those services, their outages, or what they do on their side. If you pick your provider picture as your avatar, it's loaded straight from them.

Links to other websites are there for convenience; we don't control those sites and aren't responsible for them.

Free, as is, and subject to change

The site is free, and it's provided "as is" and "as available". We may change, pause or remove any game, feature or part of the site, or shut the whole thing down, at any time and for any reason, with or without notice (we'll try to warn you about big changes). Downtime, bugs and lost scores can happen.

No promises (warranty disclaimer)

To the maximum extent permitted by law, we make no warranties or promises of any kind, express or implied, about the site, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy or availability, or that it will be uninterrupted, secure or free of errors or harmful components. In particular, we don't promise that Grandma will make it to the bottom of the hill.

Some places don't allow some of these exclusions, so some of them may not apply to you.

Limitation of liability

To the maximum extent permitted by law, Stupid Fun Games will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of data, scores, profits, revenue, goodwill or opportunities, arising out of or related to the site or these terms, whatever the legal theory, even if we were told they were possible.

To the maximum extent permitted by law, our total liability for all claims arising out of or related to the site or these terms is limited to the amount you paid us to use the site in the 12 months before the event that gave rise to the claim. The site is free, so that amount is zero (USD 0).

Nothing in these terms excludes or limits liability that can't be excluded or limited under applicable law (for example, for fraud, or for death or personal injury caused by negligence), and nothing limits rights that cannot be limited under applicable law, including mandatory consumer protections in your country of residence.

If you get us into trouble

If someone makes a claim against Stupid Fun Games because you broke these terms or the law while using the site, you agree to cover the resulting damages and reasonable costs (including reasonable legal fees), to the extent permitted by applicable law. We really hope it never comes to that.

Governing law and courts

These terms, and any dispute about them or the site, are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. Any dispute will be decided exclusively by the state and federal courts located in Delaware, and you and we agree to their jurisdiction.

If you're a consumer, this doesn't take away the protection of the mandatory laws of your country of residence, or any right you have under them to bring a claim before the courts where you live.

Before going to court, please write to privacy@stupid-fun-games.com: most problems can be solved with a friendly email.

Changes to these terms

We may update these terms, for example when we add features or the law changes. We'll change the date at the top of this page. If a change is important, we'll ask you to accept the new terms the next time you visit the site signed in: until you do, your account features (your profile and ranks, saving scores, streaks, badges, friends and profile changes) are paused, though you can still play signed out, sign out, delete your account, or get a copy of your data by writing to privacy@stupid-fun-games.com.

Small fixes (typos, clearer wording, better translations) don't need a new acceptance. If you keep using the site after a change, the new terms apply to that use.
